MANILA, Philippines – One of the lawyers representing the alleged gunman in the murder of race car driver Ferdinand “Enzo” Pastor has withdrew from the case.
In a one-page withdrawal of appearance, Jesus Fernandez of Fernandez and Fernandez Law Office said he was withdrawing as legal counsel of PO2 Edgar Angel “due to serious difference with accused.”
A source from the court said lawyer Jovino Angel, a collaboration counsel for the accused, will continue to represent the latter.
The source said Jovino is the father of Edgar.
In his comment on the lawyer’s withdrawal, Edgar said “he feels that the services being rendered by Atty. Fernandez was not sufficient to fully protect his rights and interest.”
In her one-page order, Judge Juris Dilinila-Callanta of QC Regional Trial Court Branch 85 said “the withdrawal of appearance filed by Atty. Fernandez… is hereby noted.”
Angel is the alleged gunman hired by businessman Domingo “Sandy” De Guzman III, who alongside Pastor’s widow Dalia, allegedly plotted to kill the race car driver.
De Guzman and Dalia were allegedly lovers.
In his extrajudicial confession, Angel said De Guzman hired him to kill Pastor for a consideration of P100,000.
However he later recanted his testimony, saying his admission was made under duress and it was the police themselves, who arrested and detained him at Camp Karingal in Quezon City on August 2014 that prepared the “extrajudicial confession.”
He added that the policemen threatened to implicate him in other unsolved crimes if he would not admit to Pastor’s murder.
Like Angel, De Guzman was also indicted for murder, while Dalia, who has yet to surface, was charged with parricide for the crime.
Meanwhile, the court has scheduled the next hearing on June 21 for the continuation of cross-examination of prosecution witness Paolo Salazar.
Salazar is Pastor’s aide, who was with the race car driver when he was shot dead on June 12, 2014 in Quezon City. – MBL
